Terms of Service — Pratiqo

Terms of Service — Pratiqo

1. About Pratiqo

Pratiqo is a marketplace connecting independent teachers with students in music, dance, martial arts, languages, and other learning disciplines. The platform is operated by Cours Pratiqo Inc. (“Pratiqo”), a company incorporated under the laws of Quebec, Canada.

By accessing the Pratiqo platform (website and mobile application), you agree to be bound by these Terms of Service ("Terms").


2. Definitions

  • Platform: the website pratiqo.ca and the Pratiqo mobile application
  • User: any person who accesses the platform
  • Student: a user who searches for and books lessons
  • Teacher: a user who offers lessons via the platform
  • Lesson: a teaching session booked via the platform
  • Transaction: a payment made via the platform for a lesson

3. Account Registration

3.1 Eligibility

To use Pratiqo, you must:

  • Be at least 18 years old, or a minor with parental/guardian consent
  • Provide accurate and complete information upon registration
  • Maintain the confidentiality of your login credentials

3.2 Account Responsibility

You are responsible for all activities carried out under your account. Pratiqo shall not be liable for any unauthorized access resulting from your negligence.

3.3 Account Termination

Pratiqo reserves the right to suspend or terminate any account that violates these Terms, without prior notice.


4. Services Offered

4.1 For Students

  • Search for teachers by discipline, location, and availability
  • Book and pay for online, in-person, or at-home lessons
  • Access homework and progress notes shared by the teacher
  • Rate teachers after each lesson

4.2 For Teachers

  • Create a geolocated public profile
  • Manage availability and schedule
  • Receive payments via the platform
  • Share homework and track student progress
  • Options for online, studio, or at-home lessons (within a defined radius)

4a. Teacher Status — Self-Employed

⚠️ Teachers registered on Pratiqo are SELF-EMPLOYED WORKERS and NOT employees of Pratiqo.

As such:

  • Pratiqo acts SOLELY as a technology intermediary connecting students and teachers
  • Each teacher is solely responsible for declaring their income and meeting their tax obligations
  • There is NO employment relationship between Pratiqo and teachers
  • No exclusivity is required — teachers may teach on other platforms
  • Teachers set their own rates, schedules, and teaching methods

4b. No Employment or Income Guarantee

Pratiqo does NOT PROMISE or GUARANTEE:

  • A minimum income
  • A minimum number of students or lessons
  • A booking frequency
  • Employment or an employer relationship

Income depends solely on the teacher's activity, profile quality, student satisfaction, and regional demand.


5. Fees, Commissions, and Memberships

Pratiqo may charge fees depending on the service used. The nature and amount of each fee — whether a service fee for students, a commission on transactions, a transaction fee, a subscription fee, or another fee — are clearly disclosed before confirming a booking, subscription, or payment, and can be reviewed on the platform, in the dashboard, at checkout, on the subscription page, or in the applicable plan details.

  • Access to the platform is generally free for students. A service fee may be added to the lesson price and is displayed before payment.
  • Pratiqo may charge a commission on marketplace lesson transactions, at the rate displayed on the platform and applicable to the relevant account.
  • Pratiqo may offer a paid membership (e.g., Pro Member) giving access, where offered, to economic advantages such as a reduced commission or a rebate, reward, or cashback structure. The full terms — eligibility, rates, caps, clawback conditions, billing, renewal, and cancellation — are set out in the Pro Member Terms.
  • Pratiqo may offer a loyalty, credit, or reward program for students, teachers, or both. The conditions, caps, validity periods, and calculation methods are disclosed by the platform and may evolve prospectively.
  • Pratiqo may adjust its fees and commissions prospectively, by notifying affected users in a manner consistent with applicable law.

Nothing in these Terms limits mandatory consumer rights under Quebec's Consumer Protection Act or any other applicable mandatory law.


6. Payments, Refunds, and Payouts

All payments are processed by a payment provider (e.g., Stripe). Pratiqo does not store full credit-card information.

The detailed rules governing payments, teacher payouts, refunds, holds, payout delays, disputes, and chargebacks are set out in the Payments, Refunds, and Payouts Policy and, for lesson cancellations, in the Cancellation Policy. The applicable terms, frequencies, holds, and timelines for payouts are disclosed on the platform or in the corresponding documentation, and may evolve prospectively, subject to applicable law.

For the Pro Member membership, billing, renewal, refunds, and any clawbacks are governed by the Pro Member Terms.

For YoPratiqo purchases (self-paced, one-time-purchase courses), refund conditions and 12-month access are described in the YoPratiqo Policy.


6a. YoPratiqo — Self-paced courses (one-time purchase)

YoPratiqo groups Pratiqo's self-paced, one-time-purchase courses (languages, travel, etc.). These courses are distinct from the marketplace of individual lessons covered in §6 above: a YoPratiqo purchase is a one-time buy that grants immediate access to the purchased content, with 12-month access as defined below and a 30-day satisfaction guarantee, subject to mandatory legal rights.

The complete terms — 12-month access, 30-day guarantee, EU right of withdrawal, and rules for minors — are consolidated in the dedicated YoPratiqo policy. The subsections below are a contractual summary.

A YoPratiqo purchase grants a personal, non-transferable licence to access the content, bound to the buyer's Pratiqo account. Cours Pratiqo Inc. retains all intellectual property rights in the module. See YoPratiqo policy §1.

6a.2 12-month access

The purchase of a YoPratiqo module provides personal, non-transferable access to the content for a fixed period of twelve (12) months from the purchase date, subject to mandatory legal rights. See YoPratiqo policy §2.

6a.3 30-day satisfaction guarantee

A money-back guarantee applies for 30 calendar days from the purchase date, provided the buyer has completed 25% or fewer of the lessons in the module. Refunds are issued via Stripe to the original payment method, taxes included, in the original purchase currency. See YoPratiqo policy §3.

6a.4 EU buyers

Buyers residing in the European Union have a 14-day right of withdrawal (Directive 2011/83/EU and Directive (EU) 2019/770). For digital content delivered immediately, this right can only be waived by express consent at checkout. Without that waiver, the full 14-day right is preserved. See YoPratiqo policy §4.

6a.5 Minors

In Quebec, a minor under 14 cannot enter into a consumer contract alone (Civil Code of Québec art. 157) — a YoPratiqo purchase requires parental authorization. A parent may request rescission of an unauthorized purchase (art. 163), with a full refund outside the conditions of §6a.3. See YoPratiqo policy §5.


7. At-Home and In-Person Lessons

Pratiqo acts as a technology intermediary connecting students, parents, and teachers. Safety during in-person lessons — at the student's home, at a location designated by the teacher, or in a public place — rests primarily with the participants.

The applicable rules (safe locations, presence or reachability of a parent or guardian when a lesson involves a minor, a teacher's right to refuse an unsafe location, prompt reporting of incidents, on-platform communications where reasonably possible) are described in the Teacher Terms and the Code of Conduct.


8. User Content and Conduct

It is prohibited to publish on Pratiqo any content that is false, misleading, discriminatory, harassing, infringing on copyright, or containing malware.

It is strictly prohibited to solicit students to make payments outside the platform. Any violation may result in permanent account suspension.


9. Intellectual Property

All platform elements are the exclusive property of Cours Pratiqo Inc. and are protected by copyright law.


10. Limitation of Liability

Pratiqo shall not be liable for lesson quality, incidents during lessons, data loss, or indirect damages.

Cours Pratiqo Inc.'s total liability, where the law permits such a limitation, will not exceed the service fees actually collected by Cours Pratiqo Inc. from the affected user during the twelve (12) months preceding the event.

Nothing limits liability where such a limitation is prohibited by applicable law.


11. Personal Data Protection

Pratiqo collects and processes your data in accordance with PIPEDA and Quebec Law 25. See our Privacy Policy for details.


12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec.


13. Modifications to Terms

Pratiqo reserves the right to modify these Terms at any time. Users will be notified of any substantial modification by email with 30 days notice.
